Master Service Agreement & Terms and Conditions
This Agreement applies to all services provided by Hire a Hero Home Services Corp, dba Plumb Inc, and its divisions including Hydro Jet It. By requesting service, approving an estimate, authorizing work verbally or in writing, allowing work to commence, or paying any invoice, the customer agrees to all terms stated herein.
Hire a Hero Home Services Corp, dba Plumb Inc, is fully bonded and insured, including General Liability and Workers’ Compensation, and holds California Contractor License #1095692.
The Scope of Work (“SOW”) includes only the labor, materials, procedures, and tasks expressly described in the estimate, invoice, proposal, work order, or written/digital authorization. Work is performed according to industry standards and applicable codes to the extent existing conditions allow.
Unless explicitly included in writing, the following are excluded from the SOW:
- Demolition or removal of walls, ceilings, tile, flooring, concrete, stucco, or cabinetry;
- Restoration of finishes including painting, drywall, flooring, stucco, concrete, tile, or similar work;
- Locating concealed cleanouts, abandoned piping, or hidden access points;
- Debris removal, hauling, and disposal services;
- Post-service video or camera inspection unless separately listed;
- Sewer repair, excavation, trenchless repair, or structural piping correction unless explicitly stated;
- Remediation of mold, asbestos, sewage contamination, rodents, or hazardous materials;
- Bringing existing systems up to current code standards unless specifically contracted to do so.
Plumb Inc is not responsible for failures caused by aged, corroded, damaged, or improperly installed plumbing systems. Failures that occur during or after normal service due to pre-existing conditions (including collapsed sewer lines, cracked or brittle pipes, seized valves, or leaks revealed after restoring pressure) are not the responsibility of Plumb Inc.
Drain cleaning, hydro jetting, and descaling are best-effort services intended to restore flow but do not guarantee permanent clearing, long-term performance, or structural correction. Recurring issues typically indicate defective piping or structural problems that may require repair or replacement.
Billable time begins when the technician arrives on site and continues through diagnostic work, explanation of findings, equipment preparation, performance of services, cleanup of the immediate work area, tool sanitation, documentation, and preparation to leave the property.
All hourly services are billed in full-hour increments. Any fraction of an hour is billed as a full hour. No prorated or partial-hour billing is available.
If the customer instructs Plumb Inc to stop or discontinue work before completion:
- Billable time does not end at the moment the instruction is given;
- The technician must safely cease operations, clean the work area, sanitize and pack equipment, document findings, restore access points to a safe condition, and prepare to depart;
- All time spent performing shutdown and cleanup is billable at the applicable hourly rate;
- Work shall be considered completed to the extent performed, and all charges apply in accordance with the billing rules described herein.
The customer must provide timely and safe access to the work area. Standby time is billable when:
- The technician waits more than ten (10) minutes for entry or access;
- There are delays caused by tenant coordination or unavailability;
- Utilities required for testing are turned off or unavailable;
- Furniture, storage, clutter, or other conditions obstruct access to necessary areas.
If access cannot be provided, a minimum service fee or trip charge will apply.
A minimum charge applies per visit, even if work cannot be completed due to site conditions, customer decisions, or limitations of the system.
Unless otherwise agreed in writing prior to dispatch, all payments are due immediately upon completion of the visit.
The customer agrees that the following constitute legally binding authorization to proceed with work or change orders:
- Written approval via text message;
- Written approval via email;
- Digital approval through Workiz or similar systems;
- Verbal approval given in person when payment is due upon completion;
- Verbal approval given over a recorded phone call when payment is due upon completion.
These approval methods carry the same legal effect as signing a written contract.
For residential projects requiring a home improvement contract, deposits may not exceed the lesser of ten percent (10%) of the contract price or one thousand dollars ($1,000), consistent with California law. Emergency repairs are exempt from this limitation.
Past-due invoices accrue a late fee of up to ten percent (10%) per month or ninety-nine dollars ($99) per month, whichever is greater, until paid in full.
Returned checks or rejected payment transactions incur a forty-five dollar ($45) NSF fee plus any bank-imposed charges.
The customer agrees to pay all reasonable costs associated with collection of unpaid amounts, including administrative fees, attorney’s fees, and court costs.
Residential customers may cancel a home improvement contract within three (3) business days, except when work is requested as an emergency to protect health, safety, or property. Any work already performed or materials furnished prior to cancellation remain fully due and payable.
Hire a Hero Home Services Corp, dba Plumb Inc, holds California CSLB License #1095692 and maintains a contractor’s bond, general liability insurance, and workers’ compensation insurance as required by law. Certificates of insurance are available upon request.
No warranty, whether standard or membership-based, becomes active or enforceable until all invoices related to the work are paid in full.
Plumb Inc provides a standard workmanship warranty of three hundred sixty-five (365) days on labor, subject to the exclusions described in this Agreement.
Any advertised Lifetime Labor Warranty is available only to customers enrolled in a qualifying, active membership plan that expressly includes such coverage. The Lifetime Labor Warranty remains valid only while membership payments are current and the membership remains active without lapse, suspension, or cancellation. Any nonpayment, cancellation, or lapse immediately voids the Lifetime Labor Warranty, and reinstatement is at the sole discretion of Plumb Inc.
Warranty coverage does not apply to:
- Drain cleaning results or hydro jetting outcomes;
- Failures caused by age, corrosion, structural defects, improper slope, or pre-existing damage;
- Customer-supplied materials, fixtures, or equipment;
- Manufacturer defects or issues covered solely by manufacturer warranties;
- Consequential or incidental damages, including water damage, mold, loss of use, or business interruption;
- Failures resulting from refusal of recommended repairs;
- Systems or work modified or repaired by third parties without Plumb Inc’s consent.
Customers must allow Plumb Inc reasonable access to inspect alleged defects before any warranty-related corrective action is performed. Work performed by other contractors prior to such inspection may void any warranty.
Any change to the Scope of Work, including additions, deletions, or modifications, must be approved through the authorization methods described in Section 3.2. Additional labor, materials, time, and cost may be required as a result of change orders.
Unless explicitly stated otherwise in writing, the customer is responsible for obtaining permits, paying permit fees, and scheduling any required inspections. Plumb Inc may assist with permitting services for an additional fee.
Not all systems qualify for inspection or permitting without additional upgrades. The customer must disclose prior to commencement of work if the installation is intended to be permitted or inspected by a city, county, or other authority. Work that must meet permit or inspection standards may involve additional materials, labor, and scope, and may result in different pricing than non-permit work. Work performed prior to such disclosure may require modification or rework at additional cost.
Plumb Inc performs work in compliance with applicable codes to the extent permitted by existing conditions and customer authorization. Pre-existing code violations or customer refusal to approve necessary corrective work relieve Plumb Inc of code compliance responsibility for those conditions.
The customer is responsible for contacting 811 or the appropriate utility marking service prior to any excavation or trenching work.
Access openings in walls, ceilings, floors, or other surfaces may be necessary to perform work. Unless explicitly included in the SOW, the restoration of such finishes, including patching, painting, or refinishing, is the responsibility of the customer.
Plumb Inc is not liable for damage caused by pre-existing defective, deteriorated, or brittle materials that fail during normal work.
Plumb Inc may photograph or record work areas for documentation, insurance, training, and safety purposes. Such operational documentation cannot be opted out of.
Plumb Inc may also capture photos or short clips for marketing or educational content, which may include interior spaces or faces. Customers who wish to opt out of marketing use of such images must notify Plumb Inc in writing prior to the appointment.
All media created remains the exclusive property of Hire a Hero Home Services Corp, dba Plumb Inc.
To the fullest extent permitted by law, Plumb Inc’s maximum liability for any claim relating to services provided is limited to the amount actually paid by the customer for those specific services. Plumb Inc is not liable for consequential, incidental, or special damages, including but not limited to:
- Water or sewage damage;
- Mold growth;
- Loss of use, loss of revenue, or business interruption;
- Tenant or occupant claims;
- Any damages arising from pre-existing conditions.
The customer agrees to indemnify and hold harmless Hire a Hero Home Services Corp, dba Plumb Inc, from any and all claims, damages, losses, and expenses, including attorney’s fees, arising out of or related to:
- Customer negligence or misconduct;
- Refusal of recommended repairs or corrective work;
- Failure to disclose relevant conditions or hazards;
- Actions of tenants, guests, or third parties not under Plumb Inc’s control;
- Unauthorized modifications to the work performed.
In the event of a dispute, the parties shall first attempt to resolve the matter through good-faith mediation. If mediation fails, the dispute shall be resolved by binding arbitration in accordance with California law. The venue for mediation or arbitration shall be Los Angeles County, California, unless otherwise required by statute.
Approval via text, email, digital signature, in-person verbal authorization when payment is due upon completion, or verbal authorization given over a recorded phone call constitutes full acceptance of this Agreement and authorization for Plumb Inc to proceed with the work and any approved changes.
Plumb Inc shall not be liable for delays or failure to perform arising from causes beyond its reasonable control, including but not limited to natural disasters, weather events, utility failures, supply chain disruptions, labor disputes, or governmental actions.
The customer shall not hire, solicit, or attempt to employ any Plumb Inc employee or subcontractor directly or indirectly for a period of five (5) years following the last date of service. Violation of this clause shall result in liquidated damages equal to one year of the individual’s total compensation.
Plumb Inc reserves the right to stop work without liability if conditions are unsafe, payment is not provided as agreed, the customer is unresponsive, or necessary corrective work is refused. All charges incurred up to the point of stop-work remain due and payable.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
This Agreement is governed by and construed in accordance with the laws of the State of California.
